The Children Act 1989 abolished concepts of access and custody.
The vast majority of disputes about children now concern where a child should live and who should have contact with the child. Sometimes, difficulties like these can be resolved by way of brief correspondence setting out and clarifying arrangements. However, for some, matters are far more complicated requiring the involvement of the Court to make the final decision.
The Court will always look at what is in the best interest of the child, and will not make any Order unless it feels that it has to. Contact is seen as being what is in the child's interests, and not of those seeking the contact. On many occasions, even very difficult disputes about contact and residence can be resolved by agreement.
